UK Gambling Commission Seeks Feedback on Proposed Changes to Licence Conditions and Codes of Practice
The UK Gambling Commission (UKGC) is reaching out to the gaming industry to gather feedback on its proposed amendments to the Licence Conditions and Codes of Practice (LCCP) as the Digital Markets, Competition and Consumers Act 2024 (DMCC Act) approaches. One of the key changes being considered is the removal of the UKGC’s list of approved alternative dispute resolution (ADR) providers.
Alignment with the DMCC Act
The proposed updates by the UKGC aim to align the commission with the DMCC Act. This act is set to transfer the accreditation for ADR providers to the Secretary of State, prompting the UKGC to potentially discontinue its list of approved ADR providers. Additionally, the UKGC is contemplating the removal of the LCCP footnote that guides licensees to the aforementioned list.
The DMCC Act, a new UK law, focuses on reinforcing consumer rights and protections while enhancing access to ADR. This law has replaced the previous Consumer Protection from Unfair Trading Regulations (CPUTR) 2008. Under the DMCC Act, the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations (ADRR) 2015 will be replaced with new provisions.
The UKGC is now considering changes to the LCCP that will align it with the provisions of the new law. The regulator emphasized that the proposed amendments are in response to legislative changes and will not exceed the legal obligations of licensees. Despite the changes, gaming licensees will still be required to provide free access to ADR, albeit under a revised framework.
Public Consultation
The UKGC has initiated consultations on the planned changes, inviting input from all stakeholders within the industry, including consumers, operators, and the general public. The regulator stated that the modifications will involve the replacement of wording in the LCCP with references to the DMCC Act. All interested parties are encouraged to express their views on the matter to ensure that all necessary changes have been considered and implemented appropriately.
“These views will help us decide if we have considered all the required changes and made the appropriate amendments,” stated the UKGC.
