Estonia Prepares Amendments to Gambling Act to Address Rising Gambling Concerns

Estonia’s Ministry of Finance is currently in the process of preparing amendments to the country’s Gambling Act in response to growing concerns about the impact of gambling on society. The draft of the proposed amendments is expected to be presented for feedback by mid-year.

Rainer Osanik Leads the Amendment Process

The amendments are being spearheaded by Rainer Osanik, the head of financial policies and intelligence in Estonia. Osanik recently confirmed during a briefing with the Economic Affairs Committee of the Estonian parliament that the draft of the proposed amendments will be ready by June, with implementation targeted for the first half of 2026.

One of the key focuses of the amendments will be to review online game mechanics, particularly in-play features and incentive structures. This review was prompted by concerns raised by Committee Chairman Jaak Aab regarding the increasing prevalence of “pre-addiction phases” among gamblers in the country.

Proposed Reforms and Initiatives

One of the significant changes that the Ministry of Finance is considering is the expansion of the country’s national self-exclusion program, HAMPI. The proposed expansion would allow family members to request that their relatives be added to the exclusion list, in addition to the current voluntary self-exclusion process.

Osanik emphasized the importance of the gambling tax as a vital contribution to Estonian sports and culture. He stated that while tightening regulations may reduce the number of operators, the goal is to clarify rather than restrict the existing laws.

No Changes on Loot Boxes and Taxation

Despite concerns about youth gambling, Osanik clarified that the current amendments do not include addressing loot boxes or in-game virtual currency purchases. Estonia already enforces a minimum gambling age of 21 for online players, with no minimum age limit for poker and other skill games in brick-and-mortar casinos.

Regarding taxation, no further increases are planned following adjustments made last year, which saw taxes on remote gambling, Toto, and games of chance tournaments increase from 5% to 6%. The lottery sales tax also rose from 18% to 22%.

Future Direction and Efforts

There are no renewed efforts to ban gambling advertisements in Estonia at this time. The focus remains on clarifying ad regulations and banning misleading claims rather than imposing a complete ban on gambling ads.

In neighboring countries like Latvia and Lithuania, new regulations are being developed to address the challenges posed by gambling, including limiting land-based gambling venues and updating online gambling platform regulations.
