Dutch Gambling Regulator Introduces New Requirement for Remote Gambling License Applications
The Kansspelautoriteit (KSA), the gambling regulator in the Netherlands, has recently implemented a new regulation that all operators seeking a remote gambling license must adhere to.
Mandatory “Exit Plan” Implementation
Starting from January 1, 2026, any company looking to either obtain a new license or renew an existing one will be required to provide a detailed “exit plan” outlining their strategy for leaving the market if their license expires.
The plan should specify the procedures the operator would follow to cease all operations in the Netherlands and completely withdraw from the market, should they decide not to renew their license after the initial five-year term. This plan will be a compulsory part of the license application process.
Furthermore, operators will need to submit a document detailing how they will keep the regulator informed of any changes to their policies or operations promptly. This document will be accompanied by a risk analysis focusing on compliance with anti-money laundering (AML) and counter-terrorist financing (CTF) regulations under the Act on the Prevention of Money Laundering and Terrorist Financing.
The KSA emphasized that failure to meet these new requirements could lead to the rejection of operators’ applications, even for companies that have previously held a Dutch license.
Preparation for Renewal Requests
As the legal online gambling market in the Netherlands celebrates its fourth anniversary, operators who were among the first to secure licenses are approaching the end of their initial five-year term. They will need to submit renewal applications before October 2026 to continue operating in the domestic market.
Renewal applications will undergo a different evaluation process compared to first-time applicants, including a reassessment of advertising protocols, addiction prevention policies, and integration of a control database test.
Operators with compliance issues in the past five years have been cautioned by the KSA, warning them about the potential impact of their past mistakes on their renewal applications. These providers will need to demonstrate what they have learned from previous errors and how they plan to prevent them from happening again. Failure to provide a satisfactory explanation may result in permit denial or additional conditions and restrictions.
Operators failing to comply with enforceable court rulings during the license reapplication process may be considered untrustworthy, leading to rejection of their application.
Impact of Gambling Tax Hike
In a recent development, the KSA reported that the gambling tax increase to 34.2% did not yield any additional revenue, with gross gaming revenue declining in both online and land-based markets.
