Judge Halts Prosecution of Man Injured in Casino Rama Arrest
A man from Burlington who spent more than two years battling criminal charges stemming from an incident at Casino Rama revealed that the ordeal has taken a toll on him both physically and financially. Daniel Dobson, 41, was arrested at the casino in December 2022 following a disagreement with security and Rama Police. He was accused of assaulting officers, making threats, and resisting arrest, resulting in eight charges being filed against him.
Dobson has consistently maintained his innocence, claiming that the allegations were fabricated and that he was actually the victim of an unprovoked attack. After enduring a lengthy legal battle, Justice A.M. Nichols of the Ontario Court of Justice in Orillia decided to halt the prosecution on April 7 this year, citing a violation of Dobson’s Charter right to a timely trial due to the prolonged duration of the proceedings.
A Nightmare with Lasting Effects
While Dobson expressed some relief at the court’s decision, he emphasized that the experience has been nothing short of a nightmare for him. He disclosed that he had spent approximately $25,000 in preparation for his defense against what he believes to be unfounded charges. Dobson recounted being tackled, restrained, and physically assaulted as he tried to leave the casino peacefully after being approached by security.
The altercation resulted in Dobson sustaining concussions and enduring lasting injuries to his arm and wrist. He alleged that officers covered his face with a sweatshirt, handcuffed both his hands and feet, and transported him without a seatbelt in a manner that caused him to briefly lose consciousness. Despite requesting immediate medical attention, he claimed he was denied the necessary care.
Legal Battle and Civil Lawsuit
Documents from the police accused Dobson of biting both an officer and a security guard during the scuffle. Dobson denied these allegations and enlisted the expertise of an independent forensic dentist to challenge the evidence presented against him.
In 2024, Dobson initiated a civil lawsuit seeking $3.5 million in damages against Casino Rama, its parent company Gateway Casinos and Entertainment, the Rama Police Service, and several individuals identified as officers and guards. The lawsuit alleges negligence, excessive force, false arrest, and malicious prosecution. While Casino Rama has responded with a defense, the Rama Police Service has yet to issue a formal reply.
Dobson also lodged a complaint against a Rama police constable, accusing them of mistreatment during his arrest and transportation. However, the complaint was dismissed last year following an internal review by the police chief that found no evidence of misconduct. Dobson continues to struggle with daily pain resulting from the incident and is seeking not only compensation but also accountability and an apology to address what he perceives as a failure of justice.
